THESE TERMS AND CONDITIONS GOVERN YOUR PARTICIPATION IN THE BEETA UNIVERSAL ARTS FOUNDATION PLAYWRIGHT COMPETITION (COMPETITION), WHICH IS PROVIDED BY BEETA UNIVERSAL ARTS FOUNDATION (BEETA). BY PARTICIPATING IN THIS COMPETITION YOU ARE CONFIRMING YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THESE TERMS AND CONDITIONS. THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE BY BEETA AT ANY TIME IN ITS SOLE DISCRETION. YOUR PARTICIPATION IN THIS COMPETITION AFTER SUCH CHANGES ARE IMPLEMENTED CONSTITUTE YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THE CHANGES. PLEASE CONSULT THESE TERMS AND CONDITIONS REGULARLY.
- ACCEPTANCE
You agree that you shall be bound by and comply with these Terms and Conditions for entry to the Competition. By submitting an application for the Competition, you agree to comply with these Terms and Conditions. That in the event that you fail to comply with these Terms and Conditions of entry for any reason that your entry shall not be eligible and shall be automatically disqualified from the Competition.
- INFORMATION ON THE CONTEST/COMPETITION
- ENTRY/ COMPETITION RULES
- In order to be able to enter the Competition and to be eligible to comply with these Terms and Conditions, it is a condition that you are between the ages of 18 and 40 years and of Nigerian descent. There is no entry cost. However, all costs incurred by you to the entry are your personal responsibility.
- All participants are entitled to submit only 1 (One) entry comprising an original full length manuscript for participation in the Competition.
- All entries should be written for stage production with the MAXIMUM of 10 (Ten) roles and for a MAXIMUM of 90 minutes. All entries must be made directly by the person entering the Competition and not by any proxy, representative, agent etc.
- Employees of BEETA or their family members, sponsors or service providers or any other person connected in any way whatsoever with the Competition including the setting up of the Competition is not be permitted to enter the Competition.
- All entries must be received by [Midnight] on the [ 30th September 2019] No acknowledgement of the entry will be provided by BEETA. All entries received and/or made after the end date shall not be eligible to be entered into the Competition and shall be disqualified.
- BEETA shall be entitled at its sole discretion to declare that any entry is not to be entered for the Competition and is disqualified. In such event BEETA shall not be obliged to inform you of your disqualification nor shall it be obliged to provide a reason for its decision.
- All decisions of BEETA shall be final and BEETA shall not enter into any correspondence, dialogue and/or otherwise with you regarding any aspect of the Competition.
- PARTICIPATION IN THE COMPETITION
- To participate in this Competition, you may be asked to provide certain registration details or other information or required to register to participate in this Competition. It is a condition of your participation in the Competition that you provide all such information and same is correct, current and complete. If BEETA believes the information you provide is not correct, current or complete, BEETA has the right to reject your application or refuse you access to participate in this Competition at any time.
BEETA will treat any personal information that you submit in participation in this Competition as private. During registration/participation, you will be required to provide contact information, including but not limited to an email address, your name, physical address, phone number or any other personal information. This information will be used in fulfillment of the competition you have requested to participate in.
- BEETA may release information concerning your participation in this Competition when it believes in good faith that such release is appropriate to comply with the law (for example, pursuant to a statutory demand, subpoena, warrant or court order), to protect against fraudulent, abusive or unlawful participation in this Competition, to protect BEETA’s rights or property, enforce any contract between you and BEETA, or if BEETA reasonably believes that a situation involving danger of death or injury to any person requires disclosure.
- RESTRICTIONS ON USE
You may participate in this Competition for purposes expressly permitted by BEETA. As a condition of your participation, you warrant to BEETA that you will not participate for any purpose that is unlawful or prohibited by these terms and conditions. You must not contact all or any of the sponsors or partners of BEETA. You may not modify, copy, distribute, display, send, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, content, products or services obtained from or otherwise connected to this Competition.
- SUBMISSIONS
You hereby grant to BEETA the royalty or charge free, perpetual, irrevocable, worldwide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display all submission, content, remarks, suggestions, ideas, graphics, or other information communicated to BEETA in the course of your participation (together, the “Submission”). Furthermore, BEETA will not be required to treat any Submission as confidential, and may use same for advertising/promotion without incurring any liability for royalties or any other consideration of any kind, whether at the time of use or in future.
- WINNING SUBMISSIONS
The shortlisted/winning submissions will be subject to such additional terms as may be communicated at the time of the announcement. BEETA may feature the submissions of the top 10 (Ten) finalists in a project titled New Nigerian Writing. The top 10 (Ten) finalists will be required to sign a formal contract with BEETA prior to their participation in the project.
- INFORMATION YOU PROVIDE
You may not in the course of your participation in this Competition, use any material, including personal information and your entry, that:
- You do not have the right to use or submit, including proprietary material of any third party;
- Advocates illegal activity or discusses an intent to commit an illegal act;
- Is incomplete, illegible, indecipherable, vulgar; derogatory, degrading, obscene, pornographic, racist, abusive, harassing, threatening or offensive;
- Threatens or abuses others, libels, defames, or otherwise not acceptable ;
- Infringes any intellectual property or other right of any entity or person, including violating anyone’s rights of publicity, privacy etc;
- Violates any law or may be considered to violate any law;
- Is a musical or monologue;
- Is not written in English language;
- Does not tell a Nigerian story; and
- Is not original to you, has been previously produced OR published.
- NAME AND LIKENESS
You agree and authorise BEETA to use your name, likeness, photograph, image, biographical material and other relevant information for promotional purposes.
- ADDITIONAL REQUIREMENTS FOR WINNERS OF COMPETITION
- The eventual winners will be required to sign a formal contract with BEETA prior to the redemption of their prizes.
- Fifty percent of cash winnings will be available and fifty percent will be put toward a publication of winning play, BEETA is not obliged to exchange and/or transfer any prize to another person but next of kin or personal representatives can claim winnings, subject to submission of any documents of proof requested by BEETA.
- The winners are responsible for expenses and arrangements not specifically included in the prizes, including any necessary travel arrangement to receive prizes.
- Reasonable efforts will be made to contact the winners. If the winners cannot be contacted within Thirty days, or are unable to comply with these terms and conditions, BEETA reserves the right to offer the prize to the runner(s)-up selected by the judges.
- Confirmation of the prize will be made in writing by BEETA to the winner(s), communicated through any medium deemed sufficient by Beeta.
- Failure to respond or failure to meet the eligibility requirements may result in forfeiture of the prize.
- The decision of the judges is final based on the criteria set by BEETA and BEETA shall not be obligated to respond to any correspondence over any decision.
- LIMITATION ON LIABILITY
BEETA, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES. AGENTS, OFFICERS AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER DAMAGES INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS OR SIMILAR DAMAGES, EVEN IF BEETA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- REPRESENTATIONS AND WARRANTIES
- By participating in this Competition, you represent and warrant that you have the capacity and authority to provide the information you submit, that it is accurate and complete, and that you hereby authorize use of all or any part of such information for any purposes in connection with this Competition.
- BEETA and its affiliates are not responsible for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected, or illegible entry.
- You warrant that you are the author of the material submitted for the Competition and the present and sole owner of all right, title, and interest in and to the said material. You warrant that you have exclusive, unconditional right and authority to submit said material upon the terms and conditions set forth herein; that no third party is entitled to any payment or other consideration as a condition of the exploitation of said material.
- You warrant that you have not entered any agreements (including but not limited to agreements with employers) that would prohibit you from entering into the Competition or granting any of the rights granted herein.
- INDEMNITY
You will indemnify and hold BEETA, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the Indemnified Parties) harmless from any breach of these Terms and Conditions by you. You agree that the Indemnified Parties will have no liability in connection with any such breach and you agree to indemnify any and all resulting loss, damages, judgments awards, costs, expenses and attorneys’ fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your participation in this Competition.
- SECURITY
BEETA reserves the right to investigate suspected violations of these Terms and Conditions and to fully cooperate with any law enforcement authorities or court order requesting or directing BEETA to disclose the identity of anyone who makes available any materials that are believed to violate these Terms of Use.
BY ACCEPTING THESE TERMS AND CONDITIONS AGREEMENT YOU WAIVE AND HOLD HARMLESS BEETA FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY BEETA DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER BEETA OR LAW ENFORCEMENT AUTHORITIES.
- PROTECTION OF MINORS
Children under the age of 18 (Eighteen) are not permitted to participate in this Competition.
- MISCELLANEOUS
- These Terms and Conditions will be governed and interpreted pursuant to the laws of the Federal Republic of Nigeria, notwithstanding any principles of conflicts of law. You specifically consent to the jurisdiction of Federal Republic of Nigeria in connection with any dispute between you and BEETA arising out of these Terms and Conditions or pertaining to the subject matter hereof.
- If any part of these Terms and Conditions is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
- If and to the extent that BEETA is prevented or delayed by force majeure as defined herein, BEETA shall notify you specifying the nature, extent, effect and the likely duration of the circumstances constituting the force majeure shall be relieved of any liability for failure to carry out its undertakings during such force majeure event. For the purposes of this Terms, ‘force majeure’ means any circumstances not foreseeable at the date of this Terms and not within reasonable control of BEETA, including any action taken by governmental or public authority of any kind, any civil commotion or disorder, riot, invasion, war, threat of war, preparation for war, any accident, fire, explosion, storm, flood, earthquake, epidemic or any other natural physical disaster.
- BEETA is under no obligation to use any submissions and may terminate the Competition without reason at any time by giving public notice or announcement to this effect.
- These Terms and Conditions and any supplemental terms, policies, rules and guidelines constitute the entire agreement between you and BEETA and supersede all previous written and or oral agreements relating to your entry and participation in the Competition. Notwithstanding the foregoing, any additional terms and conditions will govern the items to which they pertain. BEETA may revise or update these Terms and Conditions at any time.
